JIMA Arbitration Order

WEST BENGAL, R 495873: The only dispute involved in this arbitration case is' whether or not the  publication of JIMA will continue in the  manner it was being published or such publication will be out-sourced through the other publisher, viz., Medknow Publication Private Limited. Indian Medical Association, hereinafter referred to as "IMA", and its office bearers are the respondents in this arbitration case and the respondents intend that the publication of JIMA will be made by M/s Medknow Publication Private Limited which is a reputed publisher and well recognised for the quality of work. The Indian Medical Association is only opposing that the publisher who had been printing and publishing JIMA so long should not be allowed to print and publish the said journal, JIMA.

It is not in dispute that the IMA is the owner of the journal, JIMA. It is also not in dispute that the office of JIMA will remain in Kolkata at 53, Creek Row, Calcutta 700 014. There is also no dispute that the selection of articles and other contents to be printed in the journal, JIMA will remain with the Editorial Committee/ Editor-in-Chief of JIMA as before. The IMA is contending that the proposed publisher, viz., Medknow Publication Private Limited will collect the advertisements to be published in JIMA on its own initiative for augmenting its revenue and the publisher will not charge any. amount for printing and publishing JIMA. The Indian Medical Association has contended that on the contrary, the Medknow Publication Private Limited will give sufficient fund in the hand of Indian Medical Association out of the revenues collected by it from the' advertisements procured by it in its own initiative. The respondents have contended that if the printing and publication are allowed to be given to Medknow Publication Private Limited, the Indian Medical Association will save approximately Rs. 50.00 lacs to Rs. 70.00 lacs per year.

It has also been contended by the respondents that the respondents have the authority to decide as to how JIMA will be published and such decision of the Indian Medical Association cannot be challenged by a section of doctors or the Editorial Committee or Editorial Board. The prerogative to decide as to how JIMA will be published lies with the IMA and the decision of the IMA in deciding the manner in which the publication will be made, cannot be challenged by the claimants who being members of IMA are bound by the decision of IMA.
It appears that all the claimants are not willing to proceed with this arbitration case and two of the claimants have already withdrawn. The claimants have also failed to submit the statement as to the admission and denial of the respondents' documents inspite of repeated opportunities given by the Tribunal to do so. The claimants also failed to appear and contest the arbitration proceedings fixed for hearing on 16th November, 2014 and no intimation was given either to the Arbitrator or the respondents indicating that for any valid reason the claimants were not in a position to appear at the hearing fixed on November 16, 2014 by consent of parties. The minutes of the sitting held on November 16, 2014 clearly indicates that the Arbitrator waited for long so as to enable the claimants to appear at the hearing.

In the aforesaid facts and circumstances, the arbitration proceedings stands dismissed.

It may also be noted that the claimants have not paid Rs. 1,25,000.00 (Rupees one lac twenty-five thousand only) out of its share to pay one half of the remuneration fixed by the Hon'ble High Court at Calcutta (Rupees two lacs fifty thousand only) despite directions given by the Tribunal to pay the outstanding amount in the share of the claimants. However, the Tribunal does not intend to impose any cost on the in this arbitration case.
